Why is space 3-dimensional? The fi rst answer to this question, entirely based on Physics, was given by Ehrenfest, in 1917, who showed that the stability requirement for n-dimensional two-body planetary system very strongly constrains space dimensionality, favouring 3-d. This kind of approach will be generically called "stability postulate" throughout this paper and was shown by Tangherlini, in 1963, to be still valid in the framework of general relativity as well as for quantum mechanical hydrogen atom, giving the same constraint (...) for space{dimensionality. In the present work, before criticizing this methodology, a brief discussion has been introduced, aimed at stressing and clarifying some general physical aspects of the problem of how to determine the number of space dimensions. Then, the epistemological consequences of Ehrenfest's methodology are critically reviewed. An alternative procedure to get at the proper number of dimensions, in which the stability postulate - and the implicit singularities in three-dimensional physics - are not an essential part of the argument, is proposed. In this way, the main epistemological problems contained in Ehrenfest's original idea are avoided. The alternative methodology proposed in this paper is realized by obtaining and discussing the n-dimensional quantum theory as expressed in Planck's law, de Broglie relation and the Heisenberg uncertainty relation. As a consequence, it is possible to propose an experiment, based on thermal neutron di raction by crystals, to directly measure space dimensionality. Finally the distinguished role of Maxwell's electromagnetic theory in the determination of space dimensionality is stressed. (shrink)

Metascientific criteria used for explaining or constraining physical space dimensionality and their historical relationship to prevailing causal systems are discussed. The important contributions by Aristotle, Kant and Ehrenfest to the dimensionality of space problem are considered and shown to be grounded on different causal explanations: causa materialis for Aristotle, causa efficiens for young Kant and an ingenious combination of causa efficiens and causa formalis for Ehrenfest. In this article it is shown that a careful analysis of Kant 's Gedanken von der wahren Schätzung der lebendigen Kräfte und Beurtheilung der Beweise leads to a conclusion that does not match the usually accepted interpretation of Kant 's reasoning in 1747, according to which the young Kant supposedly establishes a relationship between the tridimensionality of space and Newton's law of gravitation. Thus, under the excluded third law it collapses to a classical formula, showing that this condition in Gabbay's definition is redundant. This paper examines the asymmetrical aspect of causal relation, confronting it to Humean and Neo-Humean's view. Following Hausman and Ehring, we favor a situational approach to causal asymmetry. We explore the Hausman's analysis of flagpole's example, clearing the connexions between causation and explanation. Our general diagnosis is that the Neo-humean tradition wrongly supposes that nomic relations, with the exception of minor details, exhaust the causal relations.

L'idea di relazionare la dimensionalità dello spazio ad una legge fisica, contenuta nel primo scritto di Kant "Pensieri sulla veridica estima delle forze vive", svela un modo di guardare i rapporti tra Fisica e Matematica così nuovo ed originale che potè essere sviluppato e compreso nella sua plenitudine soltanto nel secolo XX. Ci riferiamo qui ala prospettiva aperta da Ehrenfest nel suo "In what way does it become manifest in the fundamental laws of physics that space has three dimensions?". In (...) questo saggio si cerca di comprendere alcune delle radici fisiche, filosofiche e teologiche dell’approccio di Kant a questo problema, e la sua inserzione nel dibattito delle idee che sostengono la concezione meccanicista del Mondo. In primo luogo, si sottolinea che da una lettura attenta del suo Gedanken von der wahren Schätzung der lebendigen Kräfte si può concludere che - al contrario di quanto viene normalmente creduto - Kant non riuscì a dimostrare la sua congettura che la tridimensionalità dello spazio possa essere fondata sulla legge di gravitazione di Newton, secondo la quale la forza tra due corpi va come l'inverso del quadrato della distanza che li separa; in realtà, egli si limitò a giustificare la tridimensionalità della estensione. Dopo aver considerato la distinzione fra estensione e spazio, si fa notare che la catena logica della congettura del giovane Kant, presuppone la forza come concetto basilare, intrinseco alle sostanze. È mediante questa forza che si stabiliscono le relazioni tra le sostanze, le quali, a sua volta, creano l'ordine su cui viene basato il concetto di spazio. Si deve badare che la coerenza del suo argomento richiede, in ultima analisi, concepire la percezione, cioè, l'interazione fra le sostanze e l'anima, come risultato della medesima forza di lunga portata. Inoltre, si dimostra che l'argomento di Kant non poteva essere costrutto su una intelaiatura puramente newtoniana nel 1747. Infatti, egli costruì sua dimostrazione a partire da una concezione del mondo basata sul legato di Cartesio (soprattutto l'idea di um ordine cosmico) e Leibniz (l'esistenza di una forza che precede l'estensione e l'idea di spazio relativo) alla quale sovrappone, in modo ibrido, la legge di gravitazione di Newton. Si argomenta che questa scelta fu fortemente influenzata da alcune idee teologiche del Giovane Kant che divergono da quelle di Cartesio, Newton e Leibniz. Fu questo carattere ibrido del suo approccio che permise a Kant di trattare la questione della dimensionalità dello spazio come un problema di fisica, ma, che, allo stesso tempo, a causa delle sue limitazioni intrinsiche, portò Kant a provare appena la tridimensionalità della estensione. Monetary intelligence theory asserts that individuals apply their money attitude to frame critical concerns in the context and strategically select certain options to achieve financial goals and ultimate happiness. This study explores the dark side of monetary Intelligence and behavioral economics—dishonesty. Dishonesty, a risky prospect, involves cost–benefit analysis of self-interest. We frame good or bad barrels in the environmental context as a proxy of high or low probability of getting caught for dishonesty, respectively. We theorize: The magnitude and intensity of (...) the relationship between love of money and dishonest prospect may reveal how individuals frame dishonesty in the context of two levels of subjective norm—perceived corporate ethical values at the micro-level and Corruption Perceptions Index at the macro-level, collected from multiple sources. Based on 6382 managers in 31 geopolitical entities across six continents, our cross-level three-way interaction effect illustrates: As expected, managers in good barrels, mixed barrels, and bad barrels display low, medium, and high magnitude of dishonesty, respectively. With high CEV, the intensity is the same across cultures. With low CEV, the intensity of dishonesty is the highest in high CPI entities —the Enron Effect, but the lowest in low CPI entities. CPI has a strong impact on the magnitude of dishonesty, whereas CEV has a strong impact on the intensity of dishonesty. We demonstrate dishonesty in light of monetary values and two frames of social norm, revealing critical implications to the field of behavioral economics and business ethics. (shrink)

This study explores the bright side of Monetary Intelligence and behavioral economics, frames money attitude in the context of pay and life satisfaction, and controls money at the macro-level and micro-level. We theorize: Managers with low love of money motive but high stewardship behavior will have high subjective well-being: pay satisfaction and (...) quality of life. Data collected from 6586 managers in 32 cultures across six continents support our theory. Interestingly, GDP per capita is related to life satisfaction, but not to pay satisfaction. Individual income is related to both life and pay satisfaction. Neither GDP nor income is related to Happiness. Our theoretical model across three GDP groups offers new discoveries: In high GDP entities, “high income” not only reduces aspirations—“Rich, Motivator, and Power,” but also promotes stewardship behavior—“Budget, Give/Donate, and Contribute” and appreciation of “Achievement.” After controlling income, we demonstrate the bright side of Monetary Intelligence: Low love of money motive but high stewardship behavior define Monetary Intelligence. “Good apples enjoy good quality of life in good barrels.” This notion adds another explanation to managers’ low magnitude of dishonesty in entities with high Corruption Perceptions Index. In low GDP entities, high income is related to poor Budgeting skills and escalated Happiness. These managers experience equal satisfaction with pay and life. We add a new vocabulary to the conversation of monetary intelligence, income, GDP, happiness, subjective well-being, good and bad apples and barrels, corruption, and behavioral ethics. (shrink)

In this work, I analyze our concept of cause in the face of criticism of Bertrand Russell in his article “On the Notion of Cause”. For Russell, there is an estrangement between the notion of cause and mature science of physics. The word cause (and its correlates) would not be used in physics, thus eliminating the main justification of philosophy for his job—the foundation of science. Thus, the various causal notions and the principle of causality should be abandoned by philosophers (...) as something outdated. The aim of this study is to assess the extent to which our notion of cause, with its asymmetric nature, can be explained by physics and investigate the question of the existence of causes in our world. Corruption involves greed, money, and risky decision-making. We explore the love of money, pay satisfaction, probability of risk, and dishonesty across cultures. Avaricious monetary aspiration breeds unethicality. Prospect theory frames decisions in the gains-losses domain and high-low probability. Pay dissatisfaction (in the losses domain) incites dishonesty in the name of justice at the individual level. The Corruption Perceptions Index, CPI, signals a high-low probability of getting caught for dishonesty at the country level. We theorize that decision-makers adopt avaricious love-of-money aspiration (...) as a lens and frame dishonesty in the gains-losses domain (pay satisfaction-dissatisfaction, Level 1) and high-low probability (CPI, Level 2) to maximize expected utility and ultimate serenity. We challenge the myth: Pay satisfaction mitigates dishonesty across nations consistently. Based on 6500 managers in 32 countries, our cross-level three-dimensional visualization offers the following discoveries. Under high aspiration conditions, pay dissatisfaction excites the highest- (third-highest) avaricious justice-seeking dishonesty in high (medium) CPI nations, supporting the certainty effect. However, pay satisfaction provokes the second-highest avaricious opportunity-seizing dishonesty in low CPI entities, sustaining the possibility effect—maximizing expected utility. Under low aspiration conditions, high pay satisfaction consistently leads to low dishonesty, demonstrating risk aversion—achieving ultimate serenity. We expand prospect theory from a micro and individual-level theory to a cross-level theory of monetary wisdom across 32 nations. We enhance the S-shaped Curve to three 3-D corruption surfaces across three levels of the global economic pyramid, providing novel insights into behavioral economics, business ethics, the environment, and responsibility. Space is one of the most fundamental concepts over which scientific knowledge has been constructed. But it is also true that space concepts extrapolate by far the scientific domain, and permeate many other branches of human knowledge. Those are fascinating aspects that could di per se justify the compilation of a long bibliography. Another one is the passion for books. My interest in some physical, historical and philosophical problems concerning the concept of space in Physics, and its properties, can be (...) traced back to the early 1980. Since that time, I have being studying, with several collaborators, the influence of space dimensionality in different physical phenomena, like the Casimir Effect, neutron diffraction, Cosmic Microwave Background Radiation and the stability of Schrödinger’s and Dirac’s hydrogen atom in arbitrary number of dimensions, as well as epistemological aspects of the works of Kant, Ehrenfest an others on this particular subject. Meanwhile, I gave lectures about the History of the Concepts of Space in Physics at the Centro Brasileiro de Pesquisas Físicas (CBPF), at the Program of History of Sciences, Technics and Epistemology of the Federal University of Rio the Janeiro (UFRJ) and also at the Physics Institute of the State University of Rio de Janeiro (UERJ). As a consequence of both this interest and my love for books, I continuously bought books on space for my personal library which contains now quite one half of all the books quoted here. In 1996, Roberto Moreira and I published the Sources for the History of Space concepts in Physics: From 1845 to 1995 in the series Notas de Física of the CBPF (NF # 084/96), which is still available online. This was a first initiative to share our bibliography on space. At that time, it contained 1075 references, including 414 books entirely devoted to space, 380 articles in periodical journals and proceedings and 281 miscellaneous citations. After fifteen years, I decided to focus my attention here to collect what in my opinion are the 601 essential books which could be useful for anyone interested on learning about space. An important restriction is imposed here by language: only texts written in English, French, German, Italian, Spanish, Portuguese and Latin were considered. References are given in chronological order covering the period between 1739 and 2010. For each year, the books are listed in alphabetical order of authors’ name. The past decade has seen a burgeoning of scholarly interest in conscientious objection in healthcare. While the literature to date has focused primarily on individual healthcare practitioners who object to participation in morally controversial procedures, in this article we consider a different albeit related issue, namely, whether publicly funded healthcare institutions should be required to provide morally controversial services such as abortions, emergency contraception, voluntary sterilizations, and voluntary euthanasia. Substantive debates about institutional responsibility have remained largely at the level of (...) first-order ethical debate over medical practices which institutions have refused to offer; in this article, we argue that more fundamental questions about the metaphysics of institutions provide a neglected avenue for understanding the basis of institutional conscientious objection. To do so, we articulate a metaphysical model of institutional conscience, and consider three well-known arguments for undermining institutional conscientious objection in light of this model. We show how our metaphysical analysis of institutions creates difficulties for justifying sanctions on institutions that conscientiously object. Thus, we argue, questions about the metaphysics of institutions are deserving of serious attention from both critics and defenders of institutional conscientious objection. (shrink)

Roberto Mangabeira Unger and Lee Smolin argue for a revolution in our cosmological ideas. Ideal for non-scientists, physicists and cosmologists.

There are two main ways in which the notion of mereological fusion is usually defined in the current literature in mereology which have been labelled ‘Leśniewski fusion’ and ‘Goodman fusion’. It is well-known that, with Minimal Mereology as the background theory, every Leśniewski fusion also qualifies as a Goodman fusion. However, the converse does not hold unless stronger mereological principles are assumed. In this paper I will discuss how the gap between the two notions can be filled, focussing in particular (...) on two specific sets of principles that appear to be of particular philosophical interest. The first way to make the two notions equivalent can be used to shed some interesting light on the kind of intuition both notions seem to articulate. The second shows the importance of a little-known mereological principle which I will call ‘Mild Supplementation’. As I will show, the mereology obtained by adding Mild Supplementation to Minimal Mereology occupies an interesting position in the landscape of theories that are stronger than Minimal Mereology but weaker than what Achille Varzi and Roberto Casati have labelled ‘Extensional Mereology’. There has been significant debate about whether the moral norms of medical practice arise from some feature or set of features internal to the discipline of medicine. In this article, I analyze Edmund Pellegrino’s conception of the internal morality of medicine, and situate it in the context of Alasdair MacIntyre’s influential account of “practice.” Building upon MacIntyre, Pellegrino argued that medicine is a social practice with its own unique goals—namely, the medical, human, and spiritual good of the patient—and that the (...) moral norms that govern medical practice are derived from these goals. After providing an overview of Pellegrino’s work, I discuss some forceful objections to his theory—specifically, that it is too rigid and incapable of entering into dialogue with contemporary values systems; that it is dependent on an external conception of human flourishing; and that it is incompatible with the rapidly changing nature of modern medicine. In the final section of this article, I consider how theorists working in the Hippocratic tradition might respond to these objections against ethical essentialism by drawing upon MacIntyre’s historico-cultural method as well as what he calls Aristotle’s “metaphysical biology.”. This research aims to identify the ethical issues perceived by intensive care nurses in their everyday practice. It also aims to understand why these situations were considered an ethical issue and what interventions/strategies have been or are expected to be developed so as to minimize them. Data were collected using a semi-structured interview with 15 nurses working at polyvalent intensive care units in 4 Portuguese hospitals, who were selected by the homogenization of multiple samples. The qualitative content analysis identified end-of-life (...) decisions, privacy, interaction, team work, and health-care access as emerging ethical issues. Personal, team, and institutional aspects emerge as reasons behind the experience of these issues. Personal and team resources are used in and for solving these issues. The past decade has seen a burgeoning of scholarly interest in conscientious objection in health care. Specifically, several commentators have discussed the implications that conscientious objection has for the delivery of timely, efficient, and nondiscriminatory medical care. In this paper, I discuss the main argument put forward by the most prominent critics of conscientious objection—what I call the Professional Duty Argument or PDA. According to proponents of PDA, doctors should place patients’ well-being and rights at the center of their professional (...) practice. Doctors should be prepared to set their personal moral or religious beliefs aside where these beliefs conflict with what is legal and considered good medical practice by relevant professional associations. Conscientious objection, on this account, should be heavily restricted, if even allowed at all. I discuss two powerful objections against PDA. The first objection, which I call the fallibility objection, notes that law and professional codes of conduct are fallible guides for ethical conduct and that conscientious objection has in the past and continues today to provide a check on aberrations in law and professional convention. The second, which I call the professional discretion objection, states that restrictions on conscientious objection undermine one of the cornerstones of good medical practice, namely, a practitioner’s right to independent professional judgment. I argue that these two objections give us reason to retain conscience clauses in professional codes of conduct. (shrink)

The COVID-19 pandemic has led to the widespread use of online hearings in arbitral proceedings, raising questions about the impact of such proceedings on the determination of facts underlying a dispute. This article explores the extent to which online hearings may hinder arbitrators’ ability to assess witness credibility by drawing upon the cognitive psychology literature on truthfulness determination and lie detection. A survey of the literature suggests that the ability to differentiate truthful from dishonest statements through verbal and nonverbal cues (...) is limited, leading to the notion that observing behaviors like fidgeting, gaze aversion, vocal pitch, or body posture is not particularly relevant in assessing the credibility of a witness. Instead, focusing on the content of what is reported appears to be the most relevant strategy to determine credibility. Therefore, research does not support the idea that face-to-face contact with witnesses is essential to determine the facts of a dispute. Still, the use of in-person hearings may, in practice, continue to be preferred due to underlying cultural assumptions regarding the nature of hearings, the facilitation of communication between parties, counsel, and the tribunal, and a general sense of _Zoom fatigue_. Several ethicists have defended the use of responsibility-based criteria in healthcare rationing. Yet in this article we outline two challenges to the implementation of responsibility-based healthcare rationing policies. These two challenges are, namely, that responsibility for past behavior can diminish as an agent changes, and that blame can come apart from responsibility. These challenges suggest that it is more difficult to hold someone responsible for health related actions than proponents of responsibility-sensitive healthcare policies suggest. We close by discussing public health (...) policies that could function as an alternative to contentious, responsibility-sensitive rationing policies. (shrink)

Many if not most sperm donors in the early years of IVF donated under conditions of anonymity. There is, however, a growing awareness of the ethical cost of withholding identifying parental information from donor children. Today, anonymous donation is illegal in many jurisdictions, and some jurisdictions have gone as far as retrospectively invalidating contracts whereby donors were guaranteed anonymity. This article provides a critical evaluation of the ethics and legality of anonymous donation. We defend Australian and British legislation that has (...) outlawed donor anonymity, and we argue for the establishment of a central registry that provides donor children with the ability to easily and reliably access identifying information about their donor parents. This essay presupposes that Friedrich Nietzsche and Rudolf Carnap champion contrasting reactions to the fact that, throughout history, persons have been engaged in metaphysical disputes. Nietzsche embraces a libertarian reaction that is in agreement with his anti-democratic aristocratic political views, whereas Carnap endorses an egalitarian reaction aligned with his democratic and socialist political views. After characterizing these reactions, the essay argues for two claims. The first claim is that the stated contrasting reactions are to be considered, not only by the (...) few scholars who are interested both in Nietzsche’s and Carnap’s writings, but by a far larger group that includes those who have addressed the continental-analytic gap; those who are concerned with the development of contemporary philosophy; and/or those who are interested in the writings of Michel Foucault, Jacques Derrida, David Lewis and/or Peter van Inwagen. The second claim is that we have to entertain a synthesis of Nietzsche’s libertarian and Carnap’s egalitarian reaction in order to overcome the continental-analytic gap. (shrink)

The idea of fairness lies at the heart of the concept of justice proposed by political philosopher John Rawls, a concept that liberals have often invoked to defend the welfare state. In The Limits of Rawlsian Justice political theorist Roberto Alejandro challenges the assumptions that Rawls set out to defend his position. While other opponents of Rawls have attempted to offer an alternative to his concept of justice as fairness, Alejandro instead examines Rawls from within his own writings, testing (...) Rawls's assumptions on the basis of those assumptions themselves. As a result, Alejandro shows that Rawls's idea of justice as fairness is fraught with inner tensions, exposed to utilitarian dangers, and far from being the coherent model Rawls promised. Alejandro concludes that Rawls's notion of justice-as-fairness preserves the status quo, overlooks the realities of inequalities in today's society, and is inherently conservative. As a theoretical paradigm, it is exhausted. He urges that we acknowledge the limits of Rawlsian justice both as a defense of the welfare state and as the basis of a just society. (shrink)

We review the existing literature on this topic, and analyse both deontological and utilitarian arguments in favour of HCW prioritisation. For illustrative purposes, we focus in particular on the distribution of a COVID-19 vaccine. We also explore some practical complexities attendant on arguments in favour of HCW prioritisation.ConclusionsWe argue that there are deontological and utilitarian cases for prioritising HCWs. Indeed, the widely held view that we should prioritise HCWs represents an example of ethical convergence. Complexities arise, however, when considering who should be included in the category of HCW, and who else should receive priority in addition to HCWs. (shrink)

In this article we critically evaluate an argument against state‐sanctioned euthanasia made by David Velleman in his 1992 paper ‘Against the right to die’. In that article, Velleman argues that legalizing euthanasia is morally problematic as it will deprive eligible patients of the opportunity of staying ‘alive by default’. That is to say, those patients who are rendered eligible for euthanasia as a result of legislative reform will face the burden of having to justify their continued existence to their epistemic (...) peers if they are to be perceived as ‘reasonable’. We discuss potential criticisms that could be made of the argument, and consider how a defender of the view might respond. Velleman’s argument is particularly interesting as it is a consequentialist argument against state‐sanctioned euthanasia, challenging the many consequentialist arguments that have been made in favour of legalizing the procedure. We conclude by suggesting that further research on the question of unfair burdens is important to adequately evaluating the potential harms of legalizing euthanasia for patients at the end of life. In Fact, Fiction and Forecast, Nelson Goodman claims that the problem of justifying induction is not something over and above the problem of describing valid induction. Such claim, besides suggesting his commitment to the collapse of the distinction between the context of description and the context of justification, seems to open the possibility that the new riddle of induction could be addressed empirically. Discoveries about psychological preferences for projecting certain classes of objects could function as a criterion for determining which (...) predicates are after all projectible. In this paper, I argue that Goodman's claim must be construed within his project for constructional definitions, which is methodologically oriented by reflective equilibrium. The description of inductive practice is committed to the articulation of the extension of the class selected by the predicate ‘valid induction’. The mutual adjustment between theoretical considerations and inductive practice involved in the proposal of a definition of ‘valid induction’ must preserve that practice as much as possible, there is no way to get rid of entrenchment. Empirical discoveries about the psychological mechanism that underlies projections may help that adjustment but they cannot substitute the role played by the entrenchment of predicates. (shrink)

Postmodernism may seem a particularly inappropriate term when used in conjunction with a region that is usually thought of as having only recently, and then unevenly, acceded to modernity. Yet in the last several years the concept has risen to the top of the agenda of cultural and political debate in Latin America. This collection explores the Latin American engagement with postmodernism, less to present a regional variant of the concept than to situate it in a transnational framework. Recognizing that (...) postmodernism in Latin America can only inaccurately be thought of as having traveled from an advanced capitalist "center" to arrive at a still dependent neocolonial "periphery," the contributors share the assumption that postmodernism is itself about the dynamics of interaction between local and metropolitan cultures in a global system in which the center-periphery model has begun to break down. ‘Epistemic’ arguments for conservatism typically claim that given the limits of human reason, we are better off accepting some particular social practice or institution rather than trying to consciously improve it. I critically examine and defend here one such argument, claiming that there are some domains of social life in which, given the limits of our knowledge and the complexity of the social world, we ought to defer to those institutions that have robustly endured in a wide variety of circumstances (...) in the past while not being correlated with intolerable outcomes. These are domains of social life in which our ignorance of optimal institutions is radical, and there is uncertainty about the costs of error. This is an argument for the preservation of particular institutions, not particular policies or outcomes, and it specifically identifies these with the institutions that John Rawls called ‘the basic structure of society.’ The argument further implies that to the extent that there is any reason to change these institutions, changes should be calculated as far as possible to increase their ‘epistemic power.’. Conscience is an idea that has significant currency in liberal democratic societies. Yet contemporary moral philosophical scholarship on conscience is surprisingly sparse. This paper seeks to offer a rigorous philosophical account of the role of conscience in moral life with a view to informing debates about the ethics of conscientious objection in medicine. I argue that conscience is concerned with a commitment to moral integrity and that restrictions on freedom of conscience prevent agents from living a moral life. In section (...) one I argue that conscience is a principle of moral awareness in rational agents, and that it yields an awareness of the personal nature of moral obligation. Conscience also monitors the coherence between an agent’s identity-conferring beliefs and intentions and their practical actions. In section two I consider how human beings are harmed when they are forced to violate their conscience. Restrictions on the exercise of conscience prevent people from living in accord with their own considered understanding of the requirements of morality and undermine one’s capacity for moral agency. This article concludes with a consideration of how a robust theory of conscience can inform our understanding of conscientious objection in medicine. I argue that it is in the interest of individual practitioners and the medical profession generally to foster moral agency among doctors. This provides a prima facie justification for permitting at least some kinds of conscientious objection. (shrink)

Thomas Riisfeldt’s essay1 is a valuable contribution to the literature on palliative sedation, appropriately titrated administration of opioids and euthanasia. In this response, I will not deal with the author’s empirical claim about the relationship between opioid use, palliative sedation and survival time. Rather, I will briefly critique the author’s discussion of doctrine of double effect and its application to palliative sedation and opioid use at the end of life. That is, I will focus on the ethical claims made by (...) the author. Riisfeldt argues that DDE is incompatible with both Kantian deontology and Millian consequentialism. Yet, I will argue that the DDE is coherent and defensible when interpreted from the perspective of the philosophy of Thomas Aquinas, the theorist who first proposed the doctrine. I will also argue that Riisfeldt mischaracterises ATAOs and palliative sedation as procedures that hasten death as a means to relieve pain. While death may indeed be hastened by ATAOs and palliative sedation, it is not at all clear that clinicians intend to hasten death as a means to relieve pain. Indeed, clinical guidelines explicitly prohibit the intentional hastening of death. Riisfeldt provides a brief summary of the DDE. He describes DDE as a ‘strange hybrid of four principles’. He lists the four criteria that must be met for an act with a good and a bad effect to be permissible. These criteria are the ‘intention and means criteria’ and the ‘intrinsic and proportionality criteria’. The author uses Kant and Mill as lens through which to highlight a tension between the intrinsic and proportionality criteria of DDE. The author claims that ‘the intrinsic criterion is derived from deontology, the predominant form of which is championed by Kant’, and that ‘the proportionality criterion is derived from consequentialism, the predominant form of …. It has become common, following Stephen Darwall’s “Two Kinds of Respect”, to distinguish between “appraisal respect” and “recognition respect.” I propose, rather, to distinguish between hierarchical and egalitarian respect. The way the two meanings interact and the way they either support or contrast with each other have yet to be made clear. The meanings gathered under the broad rubric of respect can be highlighted by a genealogy that convincingly shows that the hierarchical notion is fundamental and that the definition of (...) an egalitarian meaning is a decisive shift made mainly by the Enlightenment movement, particularly by Kant. Furthermore, the notion of respect is currently being extended beyond persons—to animals, other living beings, and the environment. I argue that we can justifiably do so on the basis of the interaction between the hierarchical and egalitarian notions of respect. (shrink)
